Information on data protection and image rights
We store and process your personal data in compliance with the applicable data protection regulations, in particular the EU General Data Protection Regulation (GDPR) and the Brandenburg Data Protection Act (BbgDSG).
In addition to the provisions of the DSGVO, §§ 22 to 24 of the German Art Copyright Act (KunstUrhG) apply to the production and storage of photographs and film footage by the University of Potsdam and the use/publication of the image material.

Purpose of data processing
The purpose of processing your personal data described in more detail in the preamble is the implementation of the Potsdam Transfer event described in more detail in the registration form as part of our public duties.
If you have given your consent to the taking and use of photographs, the photographs and declarations of consent will be stored. The purpose of the data processing, in the form of the production and use of photographs and film recordings, is to inform the public about the plans of the University of Potsdam and the fulfilment of its tasks. In addition, the recordings are also made for the purpose of documenting the event formats at UP Transfer GmbH.
Legal basis for data processing
The legal basis for data processing is Art. 6 para. 1 p. 1 lit. e DSGVO in conjunction with § 14 (9) BbgHG. The provision allows the higher education institutions of the state of Brandenburg to process personal data of students, among others, but also of external users of higher education institutions. Insofar as the content of the respective event serves the transfer of knowledge and technology for the implementation and use of research and development results in practice, the associated data processing can additionally be based on Art. 6 para. 1 p. 1 lit. e DSGVO in conjunction with. § Section 3 (1) sentence 3 BbgHG and Section 5 (1) BbgDSG. The latter provision allows public bodies to process personal data if this is necessary to fulfil a task assigned to them. Pursuant to Section 3 (1) sentence 3 BbgHG, the universities of the State of Brandenburg have the task of transferring knowledge and technology for the implementation and use of their research and development results in practice.
For the production of photographs, your consent is the legal basis for data processing (Art. 6 para. 1 p. 1 lit. a GDPR). Insofar as the photographic material allows conclusions to be drawn about the health data of the person depicted, Art. 9 (2) a GDPR (explicit consent to the processing of special categories of personal data) is the legal basis for data processing.
Duration of data storage
Potsdam Transfer works in close cooperation with the UP Transfer GmbH, which provides the financial means for the realization of the event series. Potsdam Transfer is obligated according to § 147 AO, to keep the documents related to the event, such as the participant lists, for documentation and auditing purposes for the corresponding retention period of ten years.
Photographs and film recordings are stored until the expiration of the granted permission. If permission to use is granted for an unlimited period, regular reviews are carried out to determine the continued storage will take place.
Recipients of the data
Your data will be transferred to the UP Transfer GmbH at the University of Potsdam as part of the permanent cooperation between Potsdam Transfer and the UP Transfer GmbH and the UP Transfer GmbH to the UP Transfer GmbH at the University of Potsdam.

If you have consented to the publication of your photographs and film footage or to their use is permissible without consent according to § 23 KunstUrhG (cf. the information on the KunstUrhG), they can be used for the public relations of the University of Potsdam (print and online) may be made.
Your rights:
You have the right to request information from us about the processing of personal data concerning you personal data. In addition to a copy of the personal data, this right to information also includes information on the purpose of the data processing, the data recipients and the storage period.
If incorrect personal data is processed, you can request that we correct this data. If the legal requirements of Art. 17 or 18 GDPR are fulfilled, you also have the right to request the deletion of personal data or the restriction of processing. Please note that restricted processing of data may not be possible. You have the right to receive your personal data in a structured, common and machine-readable format or to request that it be transferred to another controller (Art. 20 GDPR). Insofar as data processing is permissible without your consent, you may, subject to the conditions of Art. 21 GDPR, you may object to the processing.

If you are of the opinion that the processing of your personal data is not lawful, you have the right to lodge a complaint with the competent supervisory authority for data protection with the competent data protection authority.
Information on the Art Copyright Act
In principle, consent is required for the use/publication of images and film recordings required (§ 22 KunstUrhG). Under the conditions of § 23 KunstUrhG, images may also be displayed may be displayed without consent. This exception mainly covers portraits from the field of contemporary history and pictures of meetings, processions and similar events in which the persons portrayed participated.
In contrast to the provisions of the GDPR, consent to the publication of photographic material granted under Section 22 of the German Art is in principle binding and irrevocable. Revocation is only possible if there is an important reason. You must prove that, due to a change in your inner attitude, the use of the image for a future publication would violate the law. It is pointed out that photos on the internet can be accessed by any person. The University of Potsdam cannot exclude the possibility that such persons may use the photographs use the photos or pass them on to other persons.
