Conditions for participation
The scope of these conditions of participation includes the offer of the Academic Sports Center of the University of Potsdam and of the Registered Association for the Funding of Academic Sports Potsdam - here in after referred as Academic Sports Potsdam – based on the cooperation agreement of March 2015 .
By booking an offer or participating in an offer, the participant accepts these conditions for participation. They are therefore part of the contract between the participant and the Academic Sports Potsdam.
Courses and events that take place in sports facilities of the University of Potsdam, the Film University Babelsberg and the Potsdam University of Applied Sciences are organized within the framework of the Academic Sports Center fee schedule.
The Registered Association for the Funding of Academic Sports Potsdam regulates all courses, events and participations that take place in municipal sports facilities or that fall outside the scope of the fee schedule due to their cost intensity or status.
The use of the sports facilities administered by the Registered Association for the Funding of Academic Sports Potsdam is associated with an extraordinary membership in the association, which expires after the end of the facility.
If a participant is absent without excuse for the third time in a row, the place will be given away and the claim expires without replacement.
If the event of an external provider is only arranged by the Academic Sports Potsdam, the general terms and conditions of the external provider apply. The organizer conducts the course in his own name. If the information is available online, it will be linked on the homepage of the Academic Sports Potsdam.
If the payment of the course fee cannot be processed as a direct debit, we reserve the right to block the online booking as long as the payment is considered outstanding.
In case of illness or indisposition we ask you to refrain from doing sports. If you are pregnant, please consult your doctor to find out if it is possible to participate in the course. The Academic Sports Potsdam does not allow itself to make recommendations here.
Eligibility and fees
People in status groups 1 to 4 are eligible to participate in the sports program of the Academic Sports Potsdam.

Participation in the sports program of the Academic Sports Potsdam is generally subject to a fee. The amount of the fee depends on the participant's membership in the respective status group.

Prices are adapted for the lecture-free period.
There may be price adjustments in certain sports that are particularly material- or rental-intensive.
Sports trips, training and further education and offers from third parties are excluded from this regulation.

Registration
Registration for all sports courses takes place ONLINE via the homepage of the Academic Sports Potsdam.
Parents with children (students and employees of Potsdam University and cooperating universities) have the opportunity to personally choose courses at the office of the Academic Sports Potsdam that are compatible with their daily routine up to one day before official enrollment. Proof of parenthood (birth certificate or similar) must be provided upon enrollment. The FamFIT offers are excluded from this, as the requirements are the same for all participants.
Students of the Potsdam universities to whom the social hardship applies and who would like to do sports can contact our office at any time.
The registrations for sports trips & excursions are also made ONLINE (Note: for sports trips & excursions other conditions of participation apply).
Please print out the registration confirmation as a participation ticket for presentation to the instructors.
The transfer of a registration to another person is not permitted.
Payment modalities
Each successful booking of a sports course is binding and entails a payment obligation. We reserve the right to demand this legally if necessary.
Electronic direct debit (SEPA)
By entering an account number during the online booking process, the Academic Sports Potsdam is authorized to collect the stated fee from the specified account by direct debit. The pre-notification of the direct debit will be sent by email at least 3 days before the due date. In justified exceptional cases (foreign students without an account in Germany), a cash payment can be made during the office hours of the Academic Sports Center in the secretary's office. Card payment is not possible.
Non-payment of the direct debit
In the event that a direct debit is not collected due to an objection, incorrect bank account information, or insufficient funds, the name, address, and e-mail address of the participant may be used by the Academic Sports Potsdam so that a claim for payment can be made. By participating in the payment system, the participant also agrees that in case of non-payment, this fact will be recorded in a blocking file. The blocking will be lifted as soon as the fee for the booked event as well as the bank chargeback costs charged to the Academic Sports Potsdam (currently between 5,11 € and 10,11 €) have been paid. These bank chargeback costs are automatically added to the fee due. You reserve the right to prove that the Academic Sports Potsdam has suffered less or no damage.
We would like to point out that any outstanding payment amount will be demanded by Academic Sports Potsdam in a judicial dunning procedure.
Refunds
Deposit refunds and refunds of fees for cancelled courses or after accepted withdrawals/cancellations will be made by the Academic Sports Potsdam in the form of a non-cash transfer.
A refund of paid fees is generally not possible. This does not apply to course cancellations by Academic Sports Potsdam. In the event that an offer is cancelled without substitution, the participant will receive a refund of the fees paid.
Cancellation of sports courses
The Academic Sports Potsdam can combine offers or cancel them if there are too few registrations. In the event that an offer is canceled without replacement, the participant will receive the fee back.
If individual course dates are cancelled, for example due to illness of the instructor, the Academic Sports Potsdam will try to provide a substitute or, if necessary, offer catch-up dates (see also cancellation of sports courses without entitlement to compensation).
Cancellation of sports events without entitlement to compensation:
- if the course day falls on a public holiday,
- if the course administration is prevented and the Academic Sports Potsdam does not succeed in finding a qualified replacement at short notice or offering alternative events or catch-up dates,
- in case of disruptions in the operating process (due to construction work, repairs, etc.),
- if the respective sports facility is occupied by competitions, tournaments, training courses or other events,
- due to weather conditions as well
- in the event of force majeure.
General regulations for the use of sports facilities
Access to all rooms and sports facilities that are used at events of the Academic Sports Potsdam is only permitted to people who are entitled to participate.
The Academic Sports in Potsdam is structurally organized by the Academic Sports Center (ZfH) and the Association for Funding of Academic Sports (Verein zur Förderung des Hochschulsports e.V.). Courses and events that take place in sports facilities of the University, the Film University and the University of Applied Sciences are regulated within the fee schedule of the ZfH. The Association regulates all courses, events and participations that take place in municipal sports facilities or that fall outside the scope of the fee schedule due to their cost intensity or participant status. This construct is necessary in order to provide a high volume and quality of sporting activities and to guarantee a structured, complementary offer. Activities and capacities are to be bundled and shared.
The halls may only be entered in clean indoor shoes with a non-coloring sole, which are used exclusively in sports halls. For all outdoor sports, further regulations regarding footwear apply, which are listed in the respective regulations for use. Suitable clothing appropriate to the frame must be worn during the activities. The relevant instructions in the respective course descriptions must be observed.
It is strictly prohibited to take phots of or to film exercising instructors and participants of the Academic Sports Potsdam. Such recordings are only permitted after prior consultation with the management of the Academic Sports and with the explicit approval of the individuals affected.
Bringing animals to events is strictly prohibited.
Open fire is prohibited in all rooms and sports facilities used by Academic Sports Potsdam. The preparation and serving of drinks and food in the rooms and sports facilities used by the Academic Sports Potsdam is prohibited. Exceptions only after prior consultation with the management of the Academic Sports Potsdam.
The use of all sports facilities is also governed by the terms of use of the respective facility, which contain regulations for proper and purpose-specific use. The terms of use are binding.
The instructions of the instructors and other people complying with the householder's rights must be followed. All behaviour that is contrary to the proper course of sporting events, disturbs others or poses a danger to people, buildings or property must be avoided.
Exclusion of participants
Instructors are entitled to exclude participants from the offers if their behavior seriously endangers their health or the health and well-being of the other participants despite a warning.
A violation of the conditions of participation, regulations or orders of the Academic Sports Potsdam can lead to the withdrawal of the right to participate or, if rooms and sports facilities are used, to expulsion. Instructors and participants complying to the householder’s rights are authorized to withdraw the participation tickets.
Anyone who repeatedly or seriously violates the conditions of participation, regulation or orders of the Academic Sports Potsdam can be permanently excluded from participating in the program of the Academic Sports Potsdam. This applies in particular to endangering people, improper use of sports facilities and equipment, and misuse of the right to participate. The decision on the exclusion is made by the management of the Academic Sports Potsdam.

There is an agreement between those responsible in accordance with Art. 26 DSGVO. - the organization of the registration process for the entire range of courses
- the data processing in connection with your extraordinary membership in the association, which is justified by booking a course
- the data processing necessary for the collection of the course fees
- the data processing in connection with the information about future offers of the Academic Sports Center at the University of Potsdam and the Registered Association for the Funding of Academic Sports Potsdam
- the production and use of photo and film recordings for the public relations work of the association
The Association for the Funding of Academic Sports Potsdam also acts as the primary point of contact for the assertion of data subject rights according to Chapter 3 of the DSGVO.
The Academic Sports Center at the University of Potsdam handles the following processes:
- As far as courses and events take place in sports facilities of the University of Potsdam, the Film University and the University of Applied Sciences Potsdam, your personal data will not only be processed by the Registered Association for the Funding of Academic Sports Potsdam, but also by the Academic Sports Center at the University of Potsdam.
- If you have registered as an alumnus or an alumna when booking the respective course, a random sample of data will be compared with the alumni portal to confirm that you belong to the status group you specified.
- Photo and film recordings for the University of Potsdam's public relations work are carried out by the Academic Sports Center at the University of Potsdam.
If photos and film recordings serve both the public relations work of the University of Potsdam and the Registered Association for the Funding of Academic Sports Potsdam, an overarching cooperation takes place to achieve this purpose.
Purpose of data processing
1. The purpose of processing your data (name, address, status, telephone number, e-mail address) is the booking and execution of sports offers. In case of cancellations, your account data (IBAN and BIC) will be processed additionally for the refund of already paid course fees.
2. In addition, we would like to inform you by e-mail about future sports offers and events of the Academic Sports Center and the Association for the Funding of Academic Sports Potsdam
3. For the public relations work of the University of Potsdam and the Association for the Funding of Academic Sports Potsdam photographs and films can be taken during the events and used in print and web publications of the University.
Legal grounds of the data processing
1. With the booking of an event or a course you acquire the extraordinary membership in the association according to § 5 paragraph 1 sentence 3 of the statutes of the Association for the Funding of Academic Sports Potsdam At the same time, you also use the Acadmic Sports Center of the University of Potsdam, a central university institution.
The legal basis for the data processing by the Association for the Funding of Academic Sports Potsdam is, due to the extraordinary membership in the association article 6 paragraph 1 sentence 1 letter b DSGVO acquired with the booking of a course. This regulation allows data processing as far as it is necessary for the fulfillment of a contract. The contractual relationship in the sense of the regulation also includes membership in an association. Please note that without the processing of your personal data, association membership and participation in an event or course are not possible.
If the courses you have booked take place in sports facilities of the University of Potsdam, the Film University and the Potsdam University of Applied Sciences, your data will also be processed by the Athletic Department at the University of Potsdam. If you are assigned to the alumni status group when you register for a course, the Academic Sports Center of the University of Potsdam will also randomly compare your data with the alumni portal. This data comparison verifies that you belong to the alumni status group. The legal basis for these processing shares attributable to the University of Potsdam is article 6 paragraph 1 sentence. 1 letter. e DSGVO in conjunction with § 14 paragraph 9 BbgHG. Among other things, these regulations allow the universities of the State of Brandenburg to process data in connection with the use of university facilities by students or external users.
2. In order to inform you about future events and sports offers, we need your consent. In this respect, article. 6 paragraph 1 sentence 1 letter a DSGVO is the legal basis for data processing.
3. The legal basis for the production of photographs and films by the Academic Sports Center of the University of Potsdam is article 6 paragraph 1 sentence 1letter e DSGVO in conjunction with §§ 3 paragraph 7 BbgHG, 5 paragraph 1 BbgDSG. According to § 3 paragraph 7 BbgHG the universities of the state of Brandenburg have the task to inform the public about their projects. According to § 5 paragraph 1 BbgDSG personal data may be processed by public authorities if this is necessary to fulfill the tasks assigned to you. According to this legal basis, under certain conditions, especially in connection with major events with a high public impact, photographs and films may be taken without your consent.
If photos or film recordings are made for public relations work by the Association for the Funding of Academic Sports Potsdam, the legal basis is article 6 paragraph 1 sentence 1 letter f DSGVO. This legal basis also permits the taking of photographs and film recordings without their consent if these are required for public relations work in individual cases.
Insofar as the legal bases mentioned above cannot be used for the production of photographs and film recordings, article 6 paragraph 1 sentence 1 letter a DSGVO (consent) is the legal basis for data processing. If the photographic material enables conclusions to be drawn about the health data of the persons depicted, express consent to the processing of special categories of personal data in accordance with article 9 paragraph 2 letter a DSGVO is also the legal basis for data processing.
If the photographs and/or film recordings are taken during an existing employment relationship with the university, the legal bases set out above are not applicable pursuant to article 88 DSGVO in conjunction with article 88 DSGVO. § 26 paragraph 2 BbgDSG in principle also requires a (written) consent of the employees concerned.
The use / publication of the picture material is subject to the regulations of the DSGVO and §§ 22 to 24 KunstUrhG. You will find information on this at the end of the information on data protection.
Right of withdrawal
If data processing is based on consent, you have the right to revoke your consent at any time. Revocation of your consent does not affect the legality of the processing that has been carried out on the basis of your consent until revocation.
Duration of data storage
1. Booking documents are kept according to the requirements of § 147 AO for a period of 10 years.
2. If you have given us your consent to inform you about future events and sports offers, we will store your contact details for a period of 10 years.
3. For photos and film recordings made on the basis of a consent, the storage period depends on the period for which you have given us permission to use the recordings. If the photographs were taken on a legal basis or if you have given us permission for an unlimited period of time, they will be stored for a period of up to 10 years. In addition, regular reviews will take place to determine the necessity of continuing the storage. Recordings that are no longer required are deleted in the course of the review.
Transmission of data to third parties
If you have consented to the publication of photographs or film recordings, or if, in exceptional cases, their use is also permitted without consent in accordance with § 23 KunstUrhG (cf. the following information on KunstUrhG), the recordings may be transmitted to publishers and comparable recipients for this purpose.
Your data will not be transferred to other third parties.
Your rights
You have the right to request information from us about the processing of your personal data. In addition to a copy of the personal data, this right of information also includes the purposes of data processing, data recipients and the storage period.
Should incorrect personal data be processed, you can demand that we correct this data. If the legal requirements of article 17 or 18 DSGVO are met, you also have the basic right to delete personal data or to restrict processing. Please note that a limited processing of the data may not be possible under certain circumstances. You have the right to receive your personal data in a structured, common and machine-readable format or to request that it be transferred to another responsible party (Art. 20 DSGVO).
Insofar as data processing is permitted by law without your consent, you can object to the processing under the conditions of article 21 DSGVO.

If you believe that your personal data is being processed unlawfully, you have the right to lodge a complaint with the competent data protection supervisory authority.
Insurance and liability
No liability claims beyond the legal liability can be derived from the participation in sports courses of the Academic Sports Potsdam. Any further liability for damages by the statutory body of the Academic Sports Potsdam, the state of Brandenburg, the cooperating universities, their members or against the instructors is excluded.
All participants of the sport courses of the Academic Sports are recommended to take out a personal liability insurance to cover claims for personal injury or property damage of third parties. For participation in sports trips and excursions, it is also recommended to take out insurance against cancellation, health, accident and luggage. The chosen insurance status should definitely cover include the reimbursement of search, rescue and recovery costs.
The Academic Sports Potsdam does not assume liability for theft, damage to property or other damages in the sports facilities used by the Academic Sports Potsdam.
If borrowed sports materials and/or equipment are partially or completely damaged or not returned, the borrower is liable for damages.
The Academic Sports Potsdam is not liable for damages resulting from third party events.
Only students and employees of the University, the Film University Babelsberg and the Potsdam University of Applied Sciences are insured through the accident insurance Brandenburg for designated events of the Academic Sports Potsdam. The sport must have a compensatory and not a competitive character. (GUV-SI 8083 April 2008).

All other groups are not insured. It is recommended that all sportsmen and women make sure they have sufficient accident and health insurance and personal liability insurance.
Every accident should be registered in the register of accidents of the sports facility.
Damages resulting from events of the Association for the Funding of Academic Sports Potsdam will be settled by the LSB Brandenburg. Information under:
There is no insurance cover for participation in events of cooperating institutions and third parties!
Accident reports must be reported in writing to the Academic Sports Potsdam within three days.
For sports accidents, it is advisable to seek out D-Ärzte in Potsdam on the DGUV website.
Conditions of participation for sports trips and excursions
The previous conditions of participation remain unaffected and are supplemented as follows:
Our excursions are available primarily to students and, if places are available, to members of the university. In case of further free capacities, individual places can be taken up by external users in exceptional cases on request.
Registration
With the registration you enter into a binding contract. This is only valid when the deposit fee of at least 50 percent of the total amount or the correspondingly stated deposit fee is paid by direct debit.
The balance must be paid at least two months prior to the start of the course without further request from the Academic Sports Potsdam, unless otherwise stated in the course announcement.
Cancellation by participants
Until the beginning of the event, it is possible to cancel the booked sports leisure time in writing. The date of receipt of the letter by the Academic Sports Potsdam is decisive for cancellations.
For cancellations the actual costs incurred, but at least 50.00 Euro, must be paid.
Refunds are only possible upon written request up to 14 days after the start of the course, stating BIC and IBAN and possibly power of attorney in case of co-booking!
A non-participation of the enrolled person without a written cancellation will be considered as a withdrawal. Consequently, the actual costs incurred, but at least 50.00 Euro, must be paid.
Cancellation by organizer
A withdrawal by the organizer is possible up to four weeks before the start of the course if the minimum number of participants is not reached or the contractual partners at the destination withdraw. A financial refund of the paid amount will be made.
Insurance / Liability
The participants are responsible for their own insurance coverage. It is therefore recommended that participants take out liability, accident, health, cancellation and luggage insurance.
According to the decision of the Federal Social Court (Az.: B 2 U 13/13 R of 4.12.2014), it cannot be guaranteed that students are covered against accidents. In this respect, it is a decision for each individual case.
Liability of any kind (in case of theft or other damages) will not be accepted by the organizer.
The participants are responsible for the compliance with passport and customs regulations for courses abroad.
General information about the courses
The courses are designed as group travel. The arrival is binding according to the announcement of the respective course.
Double rooms are not available for accommodation. The rooms will be distributed on site. In case of differences, the lottery will decide.
For organizational reasons, each participant acknowledges that personal data (address, date of birth, telephone number) will be passed on to the respective cooperating contractual partner.
If confirmation of registration, booking vouchers or proof of status cannot be presented at the start of the course, the trainer is entitled to record the personal data on presentation of the identity card and to pass them on to the Academic Sports Potsdam.
In the event of payment differences between the participant and the Academic Sports Potsdam, the trainer is obliged to record the personal data on presentation of the identity card and to forward them to the Acedemic Sports Potsdam.
Each instructor acknowledges the booking conditions and the specific course information. Failure to do so may result in exclusion from the course without any financial refund.
Regulations for use of the fitness club
In addition to the general conditions of participation of Academic Sports Potsdam, the following terms of use apply to the fitness clubs:
The terms of use apply to the goFIT fitness clubs of the Academic Sports Potsdam. The aim of the regulations is to ensure that all users have a pleasant stay and to maintain standards. The fitness club is organized by the Association for the Funding of Academic Sports Potsdam.
General behavior:
In the premises of the fitness clubs every participant has to behave in such a way that safety, cleanliness, order and a pleasant atmosphere are guaranteed. Anyone who harasses other users or disturbs the training may be expelled from the club. The same applies to anyone who handles the materials provided in the fitness clubs improperly or inconsiderately. The user is liable for all damages caused by improper use of the training materials or by own fault in general.
Smoking, telephoning and the consumption of food is forbidden in the entire premises of the fitness clubs, on the entire training area. Own drinks may be carried in leak-proof and unbreakable plastic bottles on the training area. A free water dispenser is available to all participants in both clubs.
At the reception, students, employees, or an adequate photo identification must be presented without being asked, which proves the training authorization in the fitness club. Only the trainer staff is allowed to stay in the trainer area (including the kitchen).
In addition, students must present proof of age (minimum age 18 years) upon request of the staff.
Training modalities:
Each new member is obliged to take part in a one-time, free instructional training before using the free training times. The introduction training can either be booked on the homepage of the fitness club or can be arranged personally in the club (goFIT +49 331 977-2044).
All facilities, facilities and equipment must be treated with care. The cardio equipment (arc trainer, rowing ergometer, treadmills and bicycles) must be cleaned after the training with the provided disinfecting liquid. When exercising on the large machines, on the weight benches and the mats, a sufficiently large towel (at least 50 x 100 cm) must be placed underneath. Rented towels are available in both clubs for a fee of 1.00 Euro. All used training materials (small equipment, dumbbells, weight plates) must be disassembled after use and returned to their original location.

Clean (indoor) sports shoes must be worn in both clubs. The use of street shoes is not allowed. During the training, suitable sportswear is to be worn, which does not bother any other guest. Changing clothes is only allowed in the appropriate changing rooms. Sports bags may not be taken to the training area, not even to the edges. For the storage of the bags and valuables there are enough lockers available (with own padlock). If the lockers are permanently occupied with padlocks, the Academic Sports Potsdam reserves the right to take measures if necessary.
Domestic authority and contravention:
The instructions of the trainer on duty and all staff members of the Academic Sports Potsdam must be followed without exception. They have the householder's rights on the premises of the fitness clubs. In the event of problems or conflicts, please contact the Academic Sports Potsdam staff member responsible, Christian Schubert (+49 331 977-1157; cschube@uni-potsdam.de). Gross or multiple violations of the rules of use will be punished immediately with immediate cancellation of the ticket contract and, if necessary, with a ban on further course bookings of the Academic Sports.
Special rules for the participation of minors
The minimum age for participation in courses of the Academic Sports is usually 18 years. The following regulations apply to the participation of minors:
1. Children under 16 years
Children and adolescents up to the age of 16 years are generally not allowed to participate in courses of the Academic Sports Potsdam . Exceptions with regard to the sole participation are the separately designated children's sports groups within the FamFIT offer of the Academic Sports Potsdam . Here the registration has to be made by the parents with the status of the parents.
2. Participants aged between 16 and 17 years - also enrolled students
Adolescents aged 16-17 years require the consent of a parent or guardian to participate. Participation can be denied by the Academic Sports Potsdam if there are reasons related to the person or behavior of the young person or the specific requirements of the offer/sport of the event speak against participation. Students pay the price of tariff group 1 in accordance with the conditions of participation of the Academic Sports Potsdam . Like all non-university members, the group of people addressed here is neither insured against accidents nor against liability when participating in courses of the Academic Sports Potsdam.
Training in the fitness clubs of the Academic Sports Potsdam is only permitted from the age of 18. It is not permitted to bring younger people.
In any case, a declaration of consent must be filled out.
Rebooking and withdrawal
Participants are not entitled to rebook or withdraw from a binding booking of a university sports program.
In justified exceptional cases, the Academic Sports Center Potsdam reserves the right to make exceptions for reasons of goodwill:
- Rebooking to another sport course or sport excursion in case of free capacities or rebooking to another person are possible in justified exceptional cases. A rebooking is generally only possible within the same booking period. Amounts already paid will be credited against the fees for the new sports course or sports excursion. In case of a rebooking to a cheaper course, no refund will be made. In case of a rebooking into a more expensive course, the payment of the remaining participation fee will be arranged non-cash by direct debit.
- In case of withdrawal from a sports course (e.g. injury, loss of place), the pro-rata fees will be retained until the day of registration. Any amounts paid in excess of this will be refunded. In this case, it is mandatory to submit proof (sick note, de-registration, etc.) within 14 days of the onset of the illness/injury, etc.
- In the case of a withdrawal from a sports event or an equivalent event (failure to meet payment deadlines), the full fees must be paid unless Hochschulsport Potsdam saves expenses. If the Hochschulsport Potsdam saves expenses, already paid amounts will be refunded. In this case, it is also mandatory to submit proof (sick note, exmatriculation, etc.).
A refund in the case of withdrawal from participation will only be considered by the Academic Sports Center if the reason for withdrawal is reported immediately and a request for refund is submitted with the written evidence after 14 days at the latest. In principle, a refund can only be granted if the remaining duration of the event is at least half of the total duration of the offer.
The Academic Sports Center reserves the right to examine the circumstances in each case. The decision on rebooking and cancellation requests is the responsibility of the Hochschulsport.
In each of these exceptional cases, a processing fee of 10 € will be retained.
